Acceptance of Terms

By accessing and using UrbanArchivium's facilities, services, or website, you agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and UrbanArchivium B.V. If you do not agree to these terms, you may not use our services or facilities.

These terms apply to all users of our services, including members, guests, visitors, and users of our website. By signing up for membership, booking services, or entering our premises, you acknowledge that you have read, understood, and agree to comply with these terms.

Description of Services

UrbanArchivium provides comprehensive fitness and wellness services, including but not limited to:

• Gym and fitness facility access
• Personal training services
• Group fitness classes
• Wellness and nutrition guidance
• Health and fitness assessments
• Equipment training and orientation

We reserve the right to modify, suspend, or discontinue any service at any time without prior notice. Service availability may vary based on membership type, facility capacity, and operational requirements.

Membership Terms

Membership Obligations

As a member of UrbanArchivium, you agree to:

• Provide accurate and complete information during registration
• Pay all fees and charges in a timely manner
• Follow all facility rules and safety guidelines
• Respect other members, staff, and property
• Notify us immediately of any changes to your contact information or health status
• Use facilities and equipment properly and safely

Payment Terms

Membership fees are due in advance according to your chosen billing cycle. Late payments may result in suspension of membership privileges. We reserve the right to change membership fees with thirty (30) days' written notice. All fees are non-refundable unless specifically stated otherwise or required by law.

Cancellation Policy

Membership cancellations must be submitted in writing at least thirty (30) days before the next billing cycle. Cancellation requests can be submitted via email to [email protected] or in person at our facility. Cancellation takes effect at the end of the current billing period.

Facility Rules and Conduct

To ensure a safe and enjoyable environment for all members, the following rules must be observed:

• Follow all posted safety guidelines and equipment instructions
• Maintain appropriate hygiene and wear suitable workout attire
• Return equipment to designated areas after use
• Respect time limits on equipment during peak hours
• No smoking, alcohol, or illegal substances on the premises
• Mobile phones should be used considerately in designated areas only
• Photography or recording is prohibited without express permission
• Children under 16 must be supervised at all times

Health and Safety

Your health and safety are paramount. Before beginning any exercise programme, you should consult with a healthcare professional, especially if you have any pre-existing medical conditions. You participate in all activities at your own risk and are responsible for informing us of any health conditions that may affect your ability to exercise safely.

UrbanArchivium staff are trained to provide fitness guidance, but they are not medical professionals. Any health or fitness advice provided is for general informational purposes only and should not replace professional medical advice.

Intellectual Property

All content on the UrbanArchivium website, including but not limited to text, graphics, logos, images, software, and fitness programmes, is the property of UrbanArchivium B.V. and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of our content without express written permission.

The UrbanArchivium name, logo, and all related marks are trademarks of UrbanArchivium B.V. You may not use these marks without our prior written consent.

Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these terms by reference. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

Limitation of Liability

To the fullest extent permitted by law, UrbanArchivium B.V., its directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of our facilities or services. This includes, but is not limited to, damages for injury, loss of profits, data loss, or business interruption.

Our total liability to you for any claims arising from these terms or your use of our services shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

Some jurisdictions do not allow the limitation of liability for personal injury or certain other damages, so these limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless UrbanArchivium B.V., its officers, directors, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from your use of our services, violation of these terms, or infringement of any third-party rights.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of the Netherlands.

If you are a consumer resident in the European Union, you may also have the right to bring proceedings in the courts of your country of residence.

Termination

Upon termination, your right to use our services ceases immediately. Sections of these terms that by their nature should survive termination shall remain in effect, including but not limited to intellectual property rights, limitation of liability, and governing law provisions.

Force Majeure

UrbanArchivium shall not be liable for any failure to perform its obligations under these terms due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, government actions, pandemics, or other emergency situations.

Severability

If any provision of these terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect. The unenforceable provision shall be replaced with an enforceable provision that most closely reflects the original intent.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after any changes constitutes acceptance of the new terms. We encourage you to review these terms periodically.
